For a person resident in India, applying outside India without written permission, and without an Indian filing at least six weeks earlier, can lead to refusal or revocation of the Indian patent.
- File in India first, or obtain permission on the prescribed form before filing abroad.
- Then use the twelve months from that first filing to decide the international route.
- Do not disclose anything publicly in the meantime.
