How do I answer a Section 3 objection?
Each clause needs different evidence. Using the wrong one wastes the reply.
Deal with each clause separately, in its own paragraph.
Section 3 objections are frequently raised in groups, and merging the answers usually means none of them is answered.
- Identify precisely which clause is relied on for which claim.
- Ask what evidence that clause requires - the answer is different for each.
- Answer the subject-matter objection before the novelty and inventive step ones; if it succeeds, the rest is moot.
