Guided answer
Who should own my trademark?
The proprietor you choose affects who can sue, who can sell and what happens if the business changes. Pick the closest situation.
Give an Indian address for service and plan for security for costs.
Moderate complexity - several routes or missing facts
- Every applicant must give an address for service in India with a postal address and an email address (rule 17), and applicants without a principal place of business in India, and convention-country applicants, must also give their home-country address (rule 15(3)).
- If no applicant has a place of business in India, the application is filed at the office covering the Indian address for service (section 18(3)).
- In an opposition, a party that neither resides nor carries on business in India may be required to give security for costs, and if it is not duly given the Registrar may treat the opposition or application as abandoned (section 21(6)).
