Guided answer

Who should own my trademark?

The proprietor you choose affects who can sue, who can sell and what happens if the business changes. Pick the closest situation.

Joint registration is possible only in limited cases.

Moderate complexity - several routes or missing facts

  • Joint proprietors can be registered where they are bound so that none may use the mark except on behalf of all, or for goods or services in respect of which they are connected in the course of trade (section 24).
  • Agree in writing on quality control, who may enforce, and how one party exits, before applying.
  • A single owner with written licences to others is often simpler. Ask an advocate which fits.

The honest answer usually needs someone to look at your actual disclosure, your timeline and the prior art. That is a conversation, not an article.
