Someone copied my technology. What are my options?

There is no patent right to enforce, but there may be something else.
What remains depends on how they came by the technology and what else you hold.
- If they had access to your confidential material, a claim in breach of confidence may be available - it depends on evidence that the information was communicated in confidence.
- Check design registration, trade mark and copyright in drawings, code and documentation.
- Filing now does not help against what they are already doing, and your own product may already be prior art.
- The real lesson is the detectability test: anything visible in the product needed a filing.
