A claim chart, element by element, tells you whether there is anything to assert - and it costs far less than finding out later.
- Take the independent claims and put each feature in a row.
- Against each, record what the competitor product actually has, with evidence.
- Any missing element means that claim is not infringed, however similar the products look.
- Then read your own prosecution history for concessions that narrow what you can assert.
