A counterclaim for revocation in the infringement suit is usually the route.
It is the cheapest moment to attack validity, and at the interlocutory stage the question is largely whether a credible challenge to validity exists.
- Commission an invalidity search immediately - documents the examiner missed are what wins.
- Read their prosecution history for concessions that narrow what they can assert.
- Map your product against each claim element; non-infringement and invalidity are separate defences and you may have both.
- Note that you generally must elect between a counterclaim and a separate revocation petition.
