Guided answer

My brand conflicts with an earlier mark. What are my options?

Relative grounds for refusal turn on how similar the marks and goods are, how well known the earlier mark is and whether the earlier owner agrees.

Well-known marks are protected even for different goods.

High complexity - significant legal consequences

  • A mark is refused for dissimilar goods or services if the earlier mark is well known in India and your use would take unfair advantage of, or harm, its distinctive character or reputation (section 11(2)).
  • In deciding whether a mark is well known, the Registrar considers factors such as recognition, duration and geography of use, promotion, registrations and enforcement record (section 11(6)). A finding in at least one relevant section of the Indian public is enough (section 11(8)), and use or registration in India cannot be required as a condition (section 11(9)).
  • If your mark is close to a famous brand, expect objection and opposition.
