Guided answer

Is my software invention patentable in India?

Section 3(k) is narrower than its reputation. This works out which side of it you are on.

That is the right starting point. Now check the specification.

Indian decisions ask whether the invention delivers a technical effect or technical contribution - and later authority accepts this can be so even on a general-purpose computer.

  • Describe the technical problem and how the claimed steps solve it, with measurements.
  • Say what improves inside the system, not what improves for the business.
  • If a model is involved, describe it specifically enough to be reproducible - the 2025 CRI Guidelines address sufficiency for AI and machine learning directly.
  • Avoid claim language whose only concrete step is a commercial decision.

This is educational guidance, not personalised legal advice. It cannot see your documents, your dates or the prior art, and those are usually what decide the answer. Use it to understand the question, then take advice on your own facts.

Not sure whether this applies to your invention?

The honest answer usually needs someone to look at your actual disclosure, your timeline and the prior art. That is a conversation, not an article.
