Where the period and any extension have expired, the application is treated as abandoned under section 21. There is usually no order to appeal.
- Take advice quickly on the exact dates - the arithmetic matters and the general extension power was rewritten in 2024.
- Note that the application has probably published, so its content is prior art against a fresh filing of the same subject matter.
- Consider whether developments since filing could support a new application on different subject matter.
