The twelve-month window is effectively immovable.
Missing it means foreign filings start fresh, without the benefit of your earlier date.
- Check whether your earlier application has published. If it has, it is prior art against a fresh foreign filing of the same subject matter.
- Assess whether there is later subject matter - genuine developments since - that could support a new filing.
- Where the earlier application has not yet published, moving quickly may still preserve something.
