Guided answer

Can I get my patent application examined faster?

Rule 24C allows expedited examination for specific kinds of applicant and application. See whether yours qualifies and what it requires.

File the expedited request on Form 18A.

Moderate complexity - several routes or missing facts

  • The request is made on Form 18A with the fee in the First Schedule, electronically and with authentication, within the period in rule 24B (31 months from the earlier of priority or filing date for applications filed on or after the 2024 amendment) (rules 24B, 24C).
  • A request already made under rule 24B can be converted by paying the fee and filing the required documents (rule 24C).
  • Once referred, the examiner report is ordinarily due within one month, not more than two; the Controller disposes of it within one month; the first statement of objections follows within 15 days; the application must be put in order for grant within six months of that statement, extendable by three months on Form 4 with fee (rule 24C).
  • A startup or small entity's request is not invalidated merely because it later loses that status (rule 24C).
  • Be ready to respond fast. Faster examination means shorter windows for your replies.
