Guided answer

A competitor has opposed my patent application or patent

Pre-grant and post-grant oppositions follow different steps and clocks. Work out which one you face.

Check whether the patent has been granted.

Moderate complexity - several routes or missing facts

  • If the Patent Office has not yet granted the patent, the document is a pre-grant representation under section 25(1). If a patent has been granted, a notice of opposition under section 25(2) can be filed within one year from publication of grant.
  • Read the document's heading, the form number and the stated grounds, then look at the register to confirm the status.

Not sure whether this applies to your invention?

The honest answer usually needs someone to look at your actual disclosure, your timeline and the prior art. That is a conversation, not an article.
