Reality

Independent invention is common and is not a defence. India is a first-to-file system: the person who filed first prevails, whatever you can prove about when you had the idea.

Simultaneous invention happens constantly, because inventions are usually responses to a problem the whole field is looking at. Your lab notebook proves you invented it. It does not give you a right, and it does not stop the other party enforcing theirs against you.

What believing it costs

Teams delay filing because they are confident nobody else is working on it. Somebody usually is.
